Question: We are due to hold a disciplinary hearing with an employee but he is saying that he is not going to attend the meeting. What should we do?
Answer: It depends on the employee’s reason from not wishing to attend the meeting. If the reason is due to the fact that their employee or Trade Union Representative cannot make the scheduled date of the meeting then you should re-schedule the meeting to another date which is within five days of the original date.
If the reason for not wanting to attend is just that they do not wish to attend the meeting then you should advise them, in writing, that if they choose not to attend then they can submit a written report of their evidence instead. At the disciplinary meeting you then consider the written evidence submitted and draw a conclusion based on the facts that you have, in much the same way as you would had the employee attended the meeting in person. |
